OF THIS LICENSE AGREEMENT AND LIMITED

WARRANTY (The "Agreement").

BY INSTALLING OR USING THIS SOFTWARE YOU

INDICATE YOUR ACCEPTANCE OF THIS

AGREEMENT. IF YOU DO NOT ACCEPT OR AGREE

WITH THESE TERMS, YOU MAY NOT INSTALL OR

USE THIS SOFTWARE!

1. Introduction. This agreement explains when and how you may use both

Registered and Freeware Copies of Oxygen SMS7110 ActiveX Control.

In this agreement:

* "Oxygen SMS7110 ActiveX Control" means the Oxygen SMS7110 ActiveX Control you

have purchased or obtained for evaluation, including both the control

software and the associated documentation and other materials.

* "Shareware Copy" means a copy of Oxygen SMS7110 ActiveX Control

distributed by us or by our authorized agents for trial use. The

Trial-Run Copy does not contain the source files.

* "Registered Copy" means a copy of the Oxygen SMS7110 ActiveX Control

source code purchased from us or an approved vendor.

* "we" or "us" means Oxygen Software.

* "you" means the end user of Oxygen SMS7110 ActiveX Control.

* "Commercial Application" any application that will be distributed

to others for any kind of compensation or fee. This includes

shareware and other try before you buy as well as commercial

distribution methods.

2. Legal Agreement. This is a legal agreement which allows you, the end

user, to use Oxygen SMS7110 ActiveX Control under certain terms and

conditions. If you cannot agree to abide by the terms of this

agreement you should not use Oxygen SMS7110 ActiveX Control.

3. Copyright. Oxygen SMS7110 ActiveX Control is fully protected by copyright

under US law and international treaty provisions.

4. Use of Oxygen SMS7110 ActiveX Control. You may use the Shareware Copy of

Oxygen SMS7110 ActiveX Control on as many computers as you like for an

unlimited time period to develop trial applications. If you have the

registered Oxygen SMS7110 ActiveX Control your use is subject to the following

restriction:

A. You may not redistribute controls derived from Oxygen SMS7110 ActiveX Control

without advanced written permission from Oxygen Software.

B. You agree to not distribute other controls total or

partially based in Oxygen SMS7110 ActiveX Control.

C. You agree to not modify the binary code for Oxygen SMS7110 ActiveX Control.

If you have the registered Oxygen SMS7110 ActiveX Control you may use

Oxygen SMS7110 ActiveX Control or a modified version of

Oxygen SMS7110 ActiveX Control within your own Commercial Applications

or non-Commercial Applications provided the above restrictions are not

violated.

You assume full responsibility for the selection and use of

Oxygen SMS7110 ActiveX Control to achieve your intended results.

5. Making and Distributing Compiled applications based in

Oxygen SMS7110 ActiveX Control. You may make copies of your applications

compiled with Oxygen SMS7110 ActiveX Control to give to others. You agree

not to distribute applications compiled with the Shareware copy of

Oxygen SMS7110 ActiveX Control. The license to distribute applications

based in the registered copy of Oxygen SMS7110 ActiveX Control is

royalty-free.

6. Copying Registered Copies of Oxygen SMS7110 ActiveX Control. When you

receive a Registered Copy of Oxygen SMS7110 ActiveX Control you may make

copies of Oxygen SMS7110 ActiveX Control software which are necessary for

normal backup purposes. You agree not to make any other copies of the

software, or any part of them, or sell or give any copies to others,

without our advance written permission.

A. You may not redistribute controls derived from Oxygen SMS7110 ActiveX Control

without advanced written permission from Oxygen Software.

B. You agree to treat the license for Oxygen SMS7110 ActiveX Control like a

book, negating the possibility that two people may use your

registered Copy simultaneously.

7. LIMITED WARRANTY: The following limited warranty applies to

Registered Copies of Oxygen SMS7110 ActiveX Control. It is included

here so you understand what your warranty will be when you

purchase a Registered Copy. This warranty does NOT apply to

Shareware Copies of Oxygen SMS7110 ActiveX Control.

Bugs and Program Errors. We do not promise that

Oxygen SMS7110 ActiveX Control will be free of bugs or program errors.

If you report a program error or bug to us, we will use our best

efforts to correct it. If we issue a maintenance release for

Oxygen SMS7110 ActiveX Control which includes a correction for an

error you reported, we will send you a copy of that maintenance

release at no charge if you request it. We will only do this for

maintenance releases, not for new major releases or other new

versions of Oxygen SMS7110 ActiveX Control.

8. Disclaimers and Limitations.

Disclaimer for Shareware Copies: You are not paying for the use

license for your Shareware Copy of Oxygen SMS7110 ActiveX Control.

Accordingly the Shareware Copy is provided "AS-IS" and without

warranty of any kind.

Disclaimer for Registered Copies: Except for the limited warranty

stated above, we disclaim any and all other warranties, express or

implied, oral or written, including any implied warranties of

merchantability or fitness for a particular purpose. The limited

warranty above gives you specific legal rights, but you may have other

rights, which vary from state to state.

Limitation of Liability: In no event shall we be liable for any

incidental, consequential, or punitive damages whatsoever arising out

of the use of Oxygen SMS7110 ActiveX Control or your relationship with us.

Some states do not allow exclusion or limitation of liability for

incidental or consequential damages, therefore the above limitation

may not apply to you.

CERTAIN JURISDICTIONS PROVIDE FOR GREATER RIGHTS THAN WHAT IS PROVIDED

INTHIS AGREEMENT. YOUR RIGHTS WITH RESPECT TO THIS AGREEMENT MAY VARY

DEPENDING ON YOUR JURISDICTION
